Fortis Institute must ensure, as required by the Florida Safety-in-Private-Spaces Act, that restrooms and changing facilities are designated for exclusive use by males, or exclusive use by females, or that there is a unisex restroom or changing facility. Should any individual enter a restroom or changing facility designated for the opposite sex (based on biological sex at birth) on the institution’s premises and refuse to depart when asked to do so by administrative personnel, instructional personnel, security or law enforcement personnel, they will be subject to disiplinary actions based upon the Disciplinary Action section of this Catalog. The only exceptions to these provisons are to accompany a person with a disability who needs assistance, to render emergency medical assistance, for custodial or maintenance purposes provided that the restroom or changing facility is not in use, or if the designated restroom or changing facility is out of order and the restroom or changing facility designated for the opposite sex is not in use.
