Fortis College will refund all monies paid by an applicant who is rejected for enrollment by the College, or who enrolls in a program that the College cancels, or who cancels within 72 hours, until midnight of the third day excluding Saturdays, Sundays and legal holidays, of signing the enrollment agreement and after receiving a tour of the facilities and equipment, but before starting class, or if the student’s enrollment was procured as a result of any misrepresentation in advertising, promotional materials of the College, or representations by representatives of the College. An applicant who cancels more than 72 hours, until midnight of the third day excluding Saturdays, Sundays and legal holidays, of signing the enrollment agreement or within student’s first three scheduled class days will be charged not more than $100 in any administrative fees as well as items of extra expense that are necessary for the portion of the program attended and stated separately on the enrollment agreement. In all cases, refunds will meet or exceed the requirements of TEC, §§132.061 and 0611 and TAC Chapter 807, Subchapter N.
